Terms of service

About these Terms
These Terms of Service (the "Terms") form a binding agreement between you, as a student or other private user of the Orbi platform, and Ornamental Tree AB (org. no. 559032-9735), Vallgatan 26, 411 16 Gothenburg, Sweden, operating the Orbi platform under the brand "Orbi" ("Orbi", "we", "us").
These Terms apply to your use of the Orbi mobile app and website, including all features such as your user account, events, tickets, memberships, chat, profile, Discounts and Connect (Career).
Separate terms apply to student organizations, associations and event organizers using Orbi. Those are published as the Orbi Terms & Conditions for Organizations.
By creating an Orbi account or otherwise using the platform, you confirm that you have read, understood and accepted these Terms and the Orbi Privacy Policy.
2. Definitions
"User" or "you" - a person who has created an Orbi account or otherwise uses the Orbi platform.
"Organizer" - a student organization, association, university, company or other entity that uses Orbi to publish events, sell tickets, manage memberships or post discounts and jobs.
"Event" - any event, gathering or activity published on Orbi by an Organizer.
"Ticket" - a digital ticket or registration confirmation purchased through the Orbi platform for an Event.
"Service Fee" - a fee charged by Orbi to the User in connection with a Ticket purchase or other paid action, shown separately at checkout.
"Content" - any text, image, message, profile information or other material that a User submits, uploads or shares on the platform.
3. Your account and eligibility
To use most features of Orbi you must create an account. You are responsible for keeping your login details secure and for all activity on your account.
Eligibility
Orbi is intended for users who are 18 years of age or older. You may create an account if you are at least 16 years of age, but some Events on the platform have higher age limits set by the Organizer. The Organizer is responsible for verifying age at the Event where required. Orbi does not actively verify the age of individual Users.
If you are under 16, you may not create an Orbi account. If we become aware that an account belongs to a person under 16, we will close it.
Account information
You agree to provide accurate information when registering and to keep your profile up to date. You may not impersonate another person, create an account on behalf of someone else without their permission, or hold more than one personal account.
Closing your account
You may close your account at any time from your Orbi profile. Account closure leads to deletion of personal data as described in the Orbi Privacy Policy. Some data may be retained where required by law (for example accounting records for 7 years).
4. The Orbi platform - what we are, and what we are not
Orbi is a technology platform that helps student organizations, associations and other organizers run events, sell tickets, manage memberships and engage with their members and audience.
Orbi is not the organizer of the events listed on the platform. The Organizer is solely responsible for the planning, content, execution, safety and legal compliance of each Event, and is your contract counterpart for the actual attendance of the Event.
Orbi provides:
Access to the platform and your account
Technical functionality for ticket purchase, ticket transfer and check-in
Payment processing through our payment provider Stripe
Chat between Users
Profile and Connect (Career) functionality
Customer support for platform-related issues
Orbi does not provide:
The Event itself or any goods or services sold by the Organizer
Guarantees that an Event will take place, that it will meet your expectations or that any specific outcome will follow from attending
Verification of the Organizer's marketing, descriptions or factual statements about an Event
5. Tickets and ticket purchases
When you purchase a Ticket through Orbi, you enter into a purchase agreement with the Organizer of the Event. Orbi acts as a technical intermediary and payment facilitator. Comparable platforms such as Eventbrite operate on a similar model.
The Organizer is responsible for the content, accuracy, lawfulness and execution of the Event. Orbi is responsible for the proper functioning of the technical purchase flow and for forwarding your payment to the Organizer in accordance with our agreement with the Organizer.
Each Ticket is subject to the Organizer's own terms, which may include rules about age, dress code, conduct at the Event, ID checks at entry and so on. By purchasing a Ticket you agree to those Organizer rules.
Tickets may be transferred to another Orbi User where the Organizer has enabled this. You are responsible for any transfer you make.
6. Prices, service fees and payment
The price of a Ticket is set by the Organizer.
In addition to the Ticket price, Orbi charges a Service Fee to the User, which may vary by market, school and Event. The Service Fee is shown separately at checkout, before you complete the purchase, so that you can see both the Ticket price and the Service Fee clearly. You confirm and agree to the total amount when you complete the purchase.
Payments are processed by Stripe. Orbi does not store your card details. By making a payment you also accept Stripe's terms applicable to the payment.
Receipts and order confirmations are sent to the email address registered on your Orbi account.
7. Cancelled events, changes and refunds
Because the Organizer is your contract counterpart for the Event, refunds, exchanges and complaints about an Event are handled by the Organizer in accordance with the Organizer's own terms. Examples include cancelled or rescheduled Events, significant changes to the program, denied entry at the door or quality complaints.
Orbi will, where technically possible and in cooperation with the Organizer, assist with the processing of approved refunds through the same payment method used for the original purchase. Where a refund is approved and processed, the Service Fee may be refunded together with the Ticket price; Orbi will indicate in the refund whether this is the case.
If an Event is cancelled in its entirety by the Organizer, Orbi will use reasonable efforts to inform affected Users through the platform and by email.
Nothing in this section limits your statutory rights as a consumer under mandatory Swedish or EU consumer law.
8. Right of withdrawal
Under the Swedish Distance Contracts Act (lag (2005:59) om distansavtal och avtal utanför affärslokaler), implementing EU Directive 2011/83/EU, consumers normally have a 14-day right of withdrawal for distance purchases.
Tickets to leisure events tied to a specific date or period (including concerts, parties, club events, sports events, screenings and similar Events offered on Orbi) are exempt from the right of withdrawal under Chapter 2, Section 11, point 12 of the Act. By completing the purchase of such a Ticket you acknowledge this exemption.
For purchases that are not exempt - for example certain digital services or non-event purchases - you may exercise your right of withdrawal within 14 days by contacting privacy@orbi.io or the Organizer, as relevant.
Creating and using an Orbi account is free of charge and does not by itself trigger any payment from which to withdraw.
9. Memberships and digital student card
If your student organization offers digital memberships or a student card through Orbi, these are issued by the organization, not by Orbi. The terms of the membership, the benefits attached to it and the duration are determined by the organization. Orbi provides the technical means to issue, store and display the membership.
10. Your content and chat
You may submit Content to the platform, for example your profile picture, biography, profile fields and chat messages.
You retain all rights to your Content. By submitting Content you grant Orbi a non-exclusive, royalty-free, worldwide license to host, store, display, transmit and otherwise process the Content for the purpose of operating, providing and developing the platform, including showing your Content to other Users and Organizers where this is the intended functionality (such as messages sent in chat or fields shared via Connect).
You are responsible for your Content. You confirm that any Content you submit:
Is yours, or that you have the necessary rights to share it on the platform
Does not infringe the rights of any third party (including intellectual property and privacy rights)
Does not violate any applicable law
Complies with the Orbi Community Guidelines set out in section 11 below
Chat moderation
Chat messages are private between the Users involved. A designated compliance representative at Orbi may review specific chat messages if they are flagged through our abuse reporting feature or where required by law, as described in the Orbi Privacy Policy. Orbi does not use chat messages for marketing, profiling or training of machine learning models.
11. Community Guidelines (acceptable use)
To keep Orbi safe and useful for everyone, the following is not allowed anywhere on the platform - including chat, profile, bio, group communications, Connect messages and any other Content you submit.
Harassment and harmful behaviour
Threats, intimidation, bullying or harassment of any person
Hate speech or content that attacks or dehumanizes people based on race, ethnicity, nationality, religion, gender, sexual orientation, gender identity, disability or other protected characteristic
Content that incites violence or self-harm
Sharing another person's private information without their consent (doxing)
Stalking, repeated unwanted contact or attempts to circumvent a block
Sexual content and protection of minors
Sexually explicit or pornographic content
Any sexual content involving minors or content that could sexualize, exploit or endanger a minor in any way - this will always be reported to law enforcement
Illegal activity and fraud
Content or behaviour that promotes, organizes or facilitates illegal activity
Sale or promotion of weapons, controlled substances or other regulated goods that you are not lawfully entitled to sell
Fraud, scams, phishing or impersonation of another person, organization or Orbi staff
Ticket scalping, ticket fraud, or buying or transferring Tickets in a manner that violates the Organizer's rules
Platform misuse
Spam, mass-messaging, unsolicited commercial messages or chain messages
Automated scraping, crawling or harvesting of data from the platform
Attempts to access systems, accounts or data you are not authorised to access, including reverse engineering or interfering with security features
Uploading viruses, malware or other harmful code
Using Orbi in a way that disrupts or degrades the service for other Users
Reporting
If you encounter Content or behaviour that violates these Guidelines, please use the in-app report function or email privacy@orbi.io. Reports are reviewed by a designated representative at Orbi. We do not share the identity of the reporter with the reported User.
12. Moderation, suspension and termination
Orbi may at its reasonable discretion remove Content, restrict features, suspend or terminate an account, or refuse Service if:
You materially breach these Terms, the Community Guidelines or applicable law
Your conduct creates a significant risk of harm to other Users, Organizers, Orbi or a third party
Orbi is required to do so to comply with a legal or regulatory obligation
Where reasonably possible, Orbi will inform you of the action taken and the reason, and give you an opportunity to respond. In cases of serious or repeated violations, in particular violations of the safety-related sections of the Community Guidelines, action may be taken immediately and without prior notice.
You may always terminate these Terms by closing your account.
13. Intellectual property
The Orbi platform, including its software, design, trademarks, logos, text, graphics and other materials provided by Orbi, is owned by Orbi or its licensors and is protected by intellectual property law. You receive a personal, non-exclusive, non-transferable right to use the platform in accordance with these Terms.
You may not copy, modify, distribute, sell, lease or create derivative works of the platform or its content, except as expressly permitted by law.
14. Personal data
Orbi's processing of personal data in connection with your use of the platform is described in the Orbi Privacy Policy, which forms part of these Terms by reference. The Privacy Policy explains what data we collect, why we collect it, how long we keep it, who we share it with and the rights you have as a data subject.
15. Disclaimers
Orbi is provided as a platform service. Within the limits of what is permitted by mandatory consumer protection law, Orbi does not warrant that:
The platform will be available without interruption or completely free from errors
Any specific Event will take place, be of a particular quality or meet your expectations
Content posted by Organizers or other Users is accurate, complete or lawful
Nothing in these Terms excludes or limits any rights you have as a consumer that cannot be excluded under applicable law.
16. Limitation of liability
To the extent permitted by mandatory law, Orbi's total liability towards you for any claim arising out of or in connection with these Terms or your use of the platform is limited to the higher of (a) the total Service Fees you have paid to Orbi during the twelve (12) months preceding the event giving rise to the claim, or (b) EUR 100.
Orbi is not liable for the actions, omissions, content or services of Organizers, Users or third parties (including Stripe and other subprocessors).
This limitation does not apply to liability for death or personal injury caused by Orbi's negligence, for fraud or fraudulent misrepresentation, or to any other liability that cannot be limited or excluded under applicable law.
17. Changes to these Terms
Orbi may update these Terms from time to time. Material changes will be notified to you through the platform or by email to the address registered on your account at least 30 days before they take effect. Non-material changes (such as clarifications and corrections) may take effect immediately.
If you do not accept a change, you may close your account before the change takes effect. Continued use of the platform after a change takes effect constitutes acceptance of the updated Terms.
18. Governing law and disputes
These Terms are governed by Swedish law, without regard to its conflict of laws principles. This does not deprive you of the protection of mandatory rules of consumer law in the EU/EEA country where you live.
If a dispute arises between you and Orbi, please contact us first at privacy@orbi.io so that we can try to resolve it. If we cannot reach an agreement, you may, as a consumer:
Refer the dispute to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN, www.arn.se), Box 174, 101 23 Stockholm
Use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr
Bring the dispute before a competent court in your country of residence or in Sweden
